General Terms and Conditions of Business for the Online Ticket Shop of FairFair GmbH

1    Scope of Validity
These general terms and conditions of business of FairFair GmbH (hereinafter referred to as FairFair) apply to contracts for the sale of admission tickets (hereinafter referred to as tickets) via the online ticket shop of FairFair GmbH, operated by service provider dimedis GmbH in Cologne, Germany, for the PaintExpo trade fair.

2    Contract Conclusion
The customer makes a binding contract offer by correctly and completely entering his personal data and all data required for payment processing to the order entry screens of the online ticket shop and submitting the order by clicking the “Order with Obligation to Pay” button.
The contract is concluded when the ticket is made available in the online ticket shop by FairFair GmbH. The customer can print the ticket himself, or forward it to his mobile phone. Admission to PaintExpo is only possible with a printed ticket or a ticket stored in the customer’s mobile phone. Purchased tickets cannot be returned for refund.

3    Prices and Payment Methods
Prices for tickets are displayed in the online ticket shop and are quoted in euros. The prices displayed at the time the respective order is placed are decisive.
Payment is currently possible by means of either credit card or instant bank transfer. FairFair GmbH reserves the right to change the offered payment methods at any time and/or to exclude certain payment methods in individual cases. Payments are processed by external payment service provider Wirecard AG, Einsteinring 35, D-85609 Aschheim, Germany, in accordance with its terms and conditions of business.
Payments are due and payable immediately after conclusion of the contract without any deductions.

4    Data Protection
The data privacy statement issued by FairFair GmbH shall apply.

5    Resale
Commercial resale of admission tickets or admission coupons is strictly prohibited.

6    Right of Withdrawal
The following withdrawal policy applies to consumers in the spirit of § 13 of the German civil code (BGB):

Right of Withdrawal
You have the right to withdraw from the contract without specifying any reasons by completing and submitting the sample withdrawal form included below, or by submitting an explicit declaration in writing (e.g. letter, e-mail, fax) to FairFair GmbH. The withdrawal deadline is 14 days after the date of conclusion of the contract. Dispatching the notice of withdrawal before expiration of the withdrawal deadline is sufficient for compliance with the deadline. Withdrawal is only possible as long as the ticket has not yet been used for admittance to PaintExpo.

Consequences of Withdrawal
If you withdraw from the contract, we will refund all payments we have received from you in connection with the contract without delay and in any case no later than fourteen days after the date on which we receive notification of your withdrawal from the contract. We will use the same means of payment for such refund as you used for the original transaction, unless otherwise expressly agreed upon with you; in no event will you be charged for such refund. The admission ticket(s) covered by the contract will then be electronically cancelled so that access to the event covered by the contract is no longer possible.

7    Cancellation by the Organiser
FairFair GmbH shall refund payments made for tickets if the event is cancelled by FairFair GmbH. Any further claims have no validity.

FairFair GmbH reserves the right to make programme changes. Insofar as the overall concept of the event is not significantly impaired, programme changes do not entitle the participant to withdraw from the contract or to any reduction in fees. This applies as well to the early closing of an event which has already begun due to force majeure, or for other reasons for which FairFair GmbH cannot be held accountable.

8    Photography
Only those persons authorised to do so by FairFair GmbH are permitted to produce commercial image recordings of any kind on the trade fair premises, in particular photographic, film and video recordings.

FairFair, as well as press and television representatives who have obtained consent from FairFair, are authorised to arrange for the production of photographs and drawings, as well as film and video recordings of the event, and to use them free of charge for advertising or press publications.

9    House Rules and Regulations
The customer undertakes to comply with all house rules specified by FairFair and Messe Karlsruhe. These can be viewed on the trade fair website at www.paintexpo.de and are an integral part of the contract.
FairFair or its authorised representatives (personnel, security service or third party provider) enforce the house rules and regulations. Their instructions and directives must be complied with.

10    Liability
FairFair is liable without limitation for damages resulting from any intentional or grossly negligent breach of duty by FairFair or any of its legal representatives or agents. FairFair is liable for inadvertently negligent violation of essential contractual obligations (obligations whose violation endangers the fulfilment of the purpose of the contract or whose fulfilment permits proper execution of the contract in the first place and upon whose fulfilment the contractual partner relies on a regular basis). However, FairFair’s liability for breach of material contractual obligations is limited to foreseeable damage typical of the contract. Liability for inadvertently negligent violation of obligations other than those mentioned in the preceding sentences is excluded.
The above specified limitations of liability do not apply in the event of injury to life, limb or health.

11    Place of Performance, Place of Jurisdiction, Applicable Law
The laws of the Federal Republic of Germany apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Place of performance and place jurisdiction is Oberboihingen, Germany.

12    Final Provisions
If any provision of these general terms and conditions of business is or becomes invalid or unenforceable, or if a necessary provision is not included, the validity of the remaining provisions of these general terms and conditions of business remain unaffected thereby. Invalid or unenforceable provisions shall be replaced and omissions shall be eliminated through the use of legally valid provisions which correspond as closely as possible to the intentions of the respective parties, or which would have corresponded to the intentions of the respective parties with regard to the purpose of this agreement had they recognised the flaw.
